General Terms And Conditions For Subscription Services

The user who validates the online subscription form on the Gay Sejour website, or who makes the subscription request by mail accepts without reservation the general subscription conditions below :

REALIZATION OF THE PUBLICATION 

The user himself, online, enters his information and downloads his images. In the event that the user requests, by email, DOMDOM SAS to carry out this operation, he will be asked for a fixed fee. This sum does not include updates and any translations requested by the user and invoiced on time (quote on request)

CONTRACT STARTING DATE AND LENGHT

The contract begins on the date of receipt of payment for the user's listing by DOMDOM SAS. This contract is concluded for an initial period of 12 months and this period cannot be reduced and does not entitle you to any refund. The contract will be renewed by tacit agreement for periods of equal duration to the initial duration, unless one of the parties has notified the other party of its wish not to renew it by post or by email addressed to the least 1 month before the expiration of the current period.

EDITING AND INTERNET SECURITY

The user is provided with secure access allowing him to modify the data of his listing. The user must implement the appropriate means to preserve the confidentiality of this access, in particular by periodically modifying the password associated with it. The user must ensure his access codes are not disclosed

CONTENTS

Should You commit any act or do anything which might tend to bring You or the Company into disrepute, contempt, or scandal, which reflects negatively on the Company and our reputation and integrity, we reserve the right to terminate this agreement with immediate effect. Reasonable investigations will be made by the Company to review claims made against You and should we deem that you have acted unjustly, the Company may issue a public redaction of any previously shared promotional material or statements made and revoke any awards given to You by the Company. You may also be required to cease using any promotional materials previously supplied to you by the Company and failure to do so may lead to legal action being taken against You. In these instances, as this will be triggered by actions and/or behaviours by You, the Company has no obligation to refund any monies that have already been paid. 

PAYMENT TERMS AND CONDITIONS 

Payment is made by credit card, bank transfer or check. In the case of payment by banck check, the user has a period of 5 full days from the date of creation to send the payment corresponding to the type of listing that he chose. If, at the end of this period, the payment has not been received by DOMDOM SAS, the listing of this client would be deleted from the site. 

PUBLICATION OF THE LISTING

The listing, its display and recording of the data provided by the user on the site is carried out by DOMDOM SAS. We warrant you that the Services will be provided using reasonable care and skill. While every care is taken to avoid errors, We cannot accept liability for any errors or omissions caused by You.  It is Your responsibility to check Your Advertisement is correct and inform Us of any mistakes in writing as soon as possible but in any event not later than the relevant deadline set out in the Order.

ACCESSIBILITY TO THE SITE

The site is accessible 24 hours a day, 7 days a week, without connection interruption. Interruption of connection to the site due to the host or any other independent technical reason not attributable to DOMDOM SAS in cases of force majeure, cannot give rise to any claim for compensation. 

PERSONAL DATA

The information collected as part of the Service is subject to computer processing. This computer processing has been declared to the CNIL (Commission nationale de l'informatique et des libertés)

OPTION FEATURED LISTING 

 The advertiser can subscribe to the Featured Listing option whereby the photograph leading to the page with full accommodation details will also be added to the rotating list of photographs appearing above the search results in all countries, regions and tourist areas concerned by accommodation. The frequency with which the advertiser's preferred ad appears depends on the number of total preferred ads subscribed for the regions concerned. 

OPTION GAY SEJOUR MAGAZINE 

Dom Dom reserves the right to refuse the execution of any insertion order or to interrupt it if it appears to it not to comply with current and future laws, regulations and practices governing advertising and the Internet, as well as only in the interests of his group.

In the event that a message does not comply with the conditions set out below, Dom Dom reserves the right to remove it from the advertising space. In any event, no compensation may be claimed for this fact by the advertiser and/or his representative.

All Advertisements are accepted subject to space being available and subject to the copy being acceptable to Us.  We reserve the right to suspend, omit, cancel or change any Advertisement or series of Advertisements at any time. Should this be due to Your act(s) or default(s) or those of Your agents, then We will charge You for the space reserved for the Advertisement, notwithstanding that the Advertisement has not been published.

The advertiser guarantees Dom Dom against any claim by authors, producers, designers, directors, publishers, interpreters and all persons who consider themselves aggrieved by the messages in any capacity whatsoever. As such, the advertiser will indemnify Dom Dom for any costs, charges and expenses that the latter would have to bear in respect of the foregoing, including fees and consulting costs, including under a court decision not yet final.

Your responsibility to supply the copy to Us by the relevant deadline as notified by Us. If the copy is not received by Us by the relevant deadline We may at Our sole discretion, either write the article utilising available online resources, produce an advertisement on behalf of the Advertiser or omit the copy from the Website. In any event the space reserved for the Advertisement shall be paid for in full. Corrections to the copy may not be incorporated unless Proofs are returned by the given deadline.

While every care is taken to avoid errors, We cannot accept liability for any errors or omissions caused by You.

 It is Your responsibility to check Your Advertisement is correct and inform Us of any mistakes in writing as soon as possible but in any event not later than the relevant deadline set out in the Order.

You will indemnify Us in full against all costs, expenses, damages and losses, including any interest, fines, legal and other professional fees and expenses awarded against or incurred or paid by Us as a result of or in connection with (i) any breach of the representations and warranties set out in clause 4.13 and (ii) any claim or allegation made against Us by any third party claiming that the Advertisement (or any part of it) infringes their Intellectual Property Rights.

In order to guarantee the best possible printing quality, Dom Dom may during the campaign ask the advertiser to provide new materials that complies with technical specifications different from those initially planned. 

SETTLEMENT OF DISPUTES 

Any complaints should be forwarded in writing to Us by no later than one ( month after the date of publication of the Advertisement to the email address: info@gay-sejour.com. This Contract and any dispute arising in connection with it is governed by and construed in accordance with the laws of France and any dispute arising in connection with this Contract are subject to the exclusive jurisdiction of the commercial courts of Marseille.
